1. Agreement to These Terms
These Terms and Conditions (the “Terms”) are a binding agreement between you (“you”) and Brevvie LLC (“Brevvie,” “we,” “us”), governing your use of the Brevvie+ website, apps, smart locker and vending systems, and related services (the “Services”), and your purchase, rental, and pickup of propane, kayaks and watercraft, firewood, and other rental items (“Products”).
By creating an account, tapping “I Agree,” making a purchase or rental, or otherwise using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms include an assumption of risk and release (Section 12), a limitation of liability that caps our responsibility to the amount you paid for the Product (Section 14), and a binding individual arbitration provision and class-action waiver (Section 16). If you do not agree, do not use the Services.
2. Definitions
“Location Operator” means a third-party partner that owns, stocks, fills, services, or operates a Brevvie+ location. “Purchase” means acquiring ownership of a Product (e.g., an exchanged propane cylinder or firewood). “Rental” means temporary possession of a Product that remains our property or the Location Operator’s and must be returned. “Rental Period” runs from dispensing/pickup until the Product is returned and confirmed received.
3. The Services; Marketplace Role
Brevvie+ provides self-service vending, locker, purchase, and rental solutions and connects consumers with Products at locations operated by Brevvie and its Location Operators. Depending on the location and Product, Brevvie may be the seller/renter of record or solely the technology platform facilitating a transaction between you and a Location Operator. Where a Location Operator stocks, fills, services, or fulfills a Product, that Location Operator—not Brevvie—is responsible for the condition, quality, and safety of that Product. Brevvie does not manufacture Products.
4. Eligibility
You must be at least 18 years old and able to form a binding contract. Certain Products carry additional age, licensing, certification, or physical-capability requirements (Section 11). You represent that you meet all applicable requirements and that your information is accurate.
5. Accounts and Security
You must provide a valid mobile phone number and any other requested information. You are responsible for the security of your account and device and for all activity and Products dispensed under your account or access code. Notify us immediately at admin@brevvie.com / 949-397-6444 of any unauthorized use.
6. Orders, Pricing, Taxes, and Payment
Prices, fees, deposits, and rental rates are shown at the time of the transaction and may vary by location and Product. Unless stated, prices exclude taxes, regulatory/environmental fees, and rental deposits, late fees, damage fees, and replacement charges. You authorize Brevvie and its payment processor to charge your payment method for the transaction and for any additional amounts you incur under these Terms, including rental extensions, late or non-returns, cleaning, damage, loss, restocking, and reasonable collection costs. We may correct pricing errors, refuse or cancel orders, and place authorization holds.
7. Refunds and Cancellations
Except where required by law, all sales of consumable and perishable Products (including propane and firewood) are final. Refund and cancellation eligibility depends on the Product and the applicable Location Operator’s policy, disclosed at or before purchase. Rental deposits are refundable only after on-time return in the required condition, less applicable fees. Report problems to admin@brevvie.com within 3 days.
8. Rentals — General Terms
For any Rental: (a) title remains with Brevvie or the Location Operator; (b) you will inspect the Product before use and not use anything that appears damaged or unsafe, but instead report it; (c) you will use the Product only for its intended consumer purpose and per all instructions, posted rules, and law; (d) you will return it to the designated location, on time, and in the same condition, ordinary wear and tear excepted; and (e) you are responsible for the Product from pickup until it is returned and confirmed received. If you return a Product late, damaged, contaminated, or not at all, you authorize charges for extension fees, cleaning, repair, full replacement value, and reasonable administrative and collection costs. Failure to return a Product may be treated as unauthorized retention of our property.
9. Vending and Smart Locker Transactions
Products dispensed through lockers, cabinets, or vending units are self-service. You are responsible for promptly retrieving your Product, securing the locker or cage, and inspecting the Product. Do not use a locker or Product that appears tampered with, damaged, or unsafe—contact support instead. We are not responsible for Products left unattended after dispensing or for losses from failure to secure a locker or cage.
10. Prohibited Uses
You agree not to: resell Products except as permitted; use Products unlawfully or for unintended purposes; tamper with, damage, relocate, or reverse-engineer any locker, vending unit, cylinder, or equipment; provide false information; allow ineligible or untrained persons to use Products under your account; transport or store Products in violation of law (including hazardous-materials and firewood-movement rules); or interfere with the Services or other users.
11. Product-Specific Terms, Safety, and Assumption of Risk
The following apply in addition to the general terms. You acknowledge that certain Products are inherently hazardous and that you assume the risks below.
11.1 Propane and Other Hazardous Materials
Propane is a flammable, pressurized, and potentially explosive material. You are solely responsible for its safe handling, transport, storage, and use, and you will follow all manufacturer instructions, cylinder labeling, and applicable federal, state, and local laws (including U.S. DOT transport requirements and OSHA/NFPA guidance where applicable). You will not allow any untrained person to handle propane equipment, and will keep cylinders away from children. You will transport cylinders upright and secured in a well-ventilated space, will not leave them in a hot or enclosed vehicle, and will not use propane appliances indoors or in unventilated spaces. You will inspect each cylinder before use, will not use any cylinder that is damaged, leaking, expired, over-filled, or emitting gas odor, and will immediately move away from and report any suspected leak, and call emergency services if there is danger. You assume all risk of fire, explosion, burns, asphyxiation, property damage, injury, or death from your handling, transport, storage, or use of propane, except to the extent caused by our gross negligence or willful misconduct. Age and quantity restrictions may apply.
11.2 Kayaks and Watercraft
Kayaking, canoeing, paddleboarding, and other watercraft activities are inherently dangerous and can result in serious injury, drowning, or death. You participate voluntarily with full knowledge of the risks, including capsizing, drowning, cold-water immersion and hypothermia, collisions, currents, tides, swells, waves, wind, weather, submerged objects, equipment failure, and the conduct of yourself and others. You will wear a properly fitted, fastened U.S. Coast Guard–approved personal flotation device (PFD) at all times on the water and comply with all posted rules, capacity limits, and boating laws. You represent that you and your party can swim (or have assessed that risk), are in adequate physical and mental condition, are not impaired by alcohol or drugs, and have the skill for the conditions. You will inspect equipment, not exceed weight/occupancy limits, check conditions before launching, and not paddle in unsafe conditions. You expressly assume all risks of watercraft activities, including those arising from the ordinary negligence of Brevvie or a Location Operator, to the fullest extent permitted by law, except gross negligence or willful misconduct.
11.3 Firewood
Firewood can harbor invasive insects and diseases. You agree to follow all “buy it where you burn it” / “don’t move firewood” guidance and all federal, state, local, park, and quarantine restrictions on moving firewood, and you accept responsibility for compliance. You will use firewood responsibly and per all fire-safety rules, burn bans, and posted regulations, and you assume all risk of fire, burns, smoke, property damage, or injury from storage or use. Firewood is a natural product; quantities, moisture, and dimensions are approximate, with no warranty of species, seasoning, or heat output except as stated at purchase.
11.4 Other Rental Items
For all other rental items, you assume the risks inherent in the activity, agree to use the item only as intended and instructed, and accept the general rental obligations in Section 8, including return, inspection, and responsibility for damage, loss, or late return.
12. Assumption of Risk; Release of Liability
To the fullest extent permitted by law, you knowingly and voluntarily assume all risks—known and unknown—of personal injury, death, illness, and property damage arising from your use of the Products and Services, and you release, waive, and covenant not to sue Brevvie LLC, the Location Operators, and their respective owners, officers, directors, employees, agents, and affiliates (the “Released Parties”) from any and all claims arising from such use, including claims based on the ordinary negligence of the Released Parties. This release does not apply to liability that cannot be waived by law, or to gross negligence or willful misconduct. California users expressly waive California Civil Code Section 1542, which provides that a general release does not extend to claims the releasing party does not know or suspect to exist at the time of the release and that, if known, would have materially affected the settlement.
13. Disclaimer of Warranties
The Services and Products are provided “as is” and “as available,” with all faults and without warranty of any kind. To the fullest extent permitted by law, the Released Parties disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free, that lockers or Products will always be available, or that any Product is fit for any use beyond its ordinary consumer purpose.
14. Limitation of Liability
To the fullest extent permitted by law, the Released Parties will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from the Services or Products, under any legal theory, even if advised of the possibility. In no event will the total aggregate liability of the Released Parties for any claim arising out of or relating to a Product or transaction exceed the amount you actually paid to Brevvie for that specific Product or rental. Where no amount was paid, maximum aggregate liability will not exceed USD $25.
Any claim arising out of the Services or Products must be brought within one (1) year after the event giving rise to it, or it is permanently barred. Nothing here limits liability for gross negligence, willful misconduct, fraud, or any liability that cannot be limited under applicable law.
15. Indemnification
You agree to indemnify, defend, and hold harmless the Released Parties from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from: (a) your use or misuse of the Products or Services; (b) your violation of these Terms or law; (c) your transport, storage, handling, or use of any Product (including propane, watercraft, and firewood); (d) your negligence or willful misconduct; or (e) your violation of any third party’s rights.
16. Dispute Resolution; Binding Arbitration; Class-Action Waiver
Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court and to have a jury trial.
Informal Resolution. Before arbitration, you and Brevvie agree to try to resolve any dispute informally for at least 30 days after written notice to 19552 Summer Breeze Lane, Huntington Beach, CA 92648 / admin@brevvie.com.
Agreement to Arbitrate. Except for the exceptions below, you and Brevvie agree that any dispute arising out of or relating to these Terms, the Services, or the Products will be resolved by binding individual arbitration, not in court, except that either party may bring a qualifying individual claim in small-claims court. This agreement is governed by the Federal Arbitration Act.
Administrator, Rules, and Location. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, before a single neutral arbitrator, and will take place in Orange County, California, unless the parties agree otherwise or law requires a different location.
Class-Action and Jury Waiver. You and Brevvie agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate claims or preside over any representative or class proceeding. You and Brevvie waive any right to a jury trial.
Exceptions. This section does not require arbitration of: (a) qualifying small-claims-court claims; (b) claims for injunctive or equitable relief to protect intellectual property or the Services; and (c) any claim that law provides may not be subject to pre-dispute arbitration. If the class-action waiver is unenforceable as to a particular claim (e.g., certain public-injunctive-relief claims under California law), that claim is severed to court while the rest proceed in arbitration.
30-Day Right to Opt Out. You may opt out of this arbitration agreement within 30 days after first accepting these Terms by sending written notice to admin@brevvie.com with your name, account phone number, and a clear statement that you wish to opt out. Opting out will not affect the rest of these Terms.
Governing Law. These Terms and any dispute are governed by the laws of the State of California, without regard to conflict-of-laws rules. For any matter not subject to arbitration, you and Brevvie consent to the exclusive jurisdiction and venue of the state and federal courts in Orange County, California.
17. Privacy and Electronic Communications
We collect and use your information as described in our . Your phone number is used for authentication, transaction and order notifications, and service communications. By using the Services you consent to receive transactional communications and, where opted in, other messages; message and data rates may apply. You agree we may provide notices electronically.
18. Intellectual Property
The Services, including all software, content, trademarks (including “Brevvie” and “Brevvie+”), logos, and designs, are owned by or licensed to Brevvie. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose. You may not copy, modify, distribute, sell, or create derivative works without our prior written consent.
19. Suspension and Termination
We may suspend, restrict, or terminate your access or account at any time, with or without notice, including for violation of these Terms, suspected fraud or misuse, safety concerns, or non-payment. Upon termination you must promptly return any rental Products. Sections that by their nature should survive termination will survive.
20. Force Majeure
The Released Parties are not liable for any failure or delay caused by events beyond their reasonable control, including acts of God, natural disasters, fire, flood, severe weather, epidemic or pandemic, labor disputes, supply-chain disruptions, utility or telecommunications failures, governmental action, or Product or inventory shortages. We may allocate or limit Product availability during such events.
21. Changes to the Services and Terms
We may modify the Services or these Terms at any time. For material changes we will update the “Last updated” date and, where appropriate, provide additional notice. Continued use after changes become effective constitutes acceptance. If you do not agree, stop using the Services.
22. General
These Terms, with the Privacy Policy and any location- or Product-specific terms, are the entire agreement regarding the Services and supersede prior agreements. If any provision is unenforceable, it will be limited or severed and the rest will remain in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our consent; we may assign to an affiliate or successor. Nothing here creates a partnership, joint venture, agency, or employment relationship.

1. Introduction
This Privacy Policy explains how Brevvie LLC (“Brevvie,” “we,” “us”) collects, uses, and protects personal information when you use the Brevvie+ website, apps, smart locker and vending systems, and related services (the “Services”). It is incorporated into and part of the Brevvie+ Terms and Conditions. By using the Services, you acknowledge that you have read and understood this Privacy Policy.
2. The Short Version
We collect only the information we need to operate, secure, and improve the Services and to complete your transactions. We use your information only to provide and improve the Services. We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We do not disclose your personal information outside of Brevvie LLC and its wholly owned affiliates, except to service providers who process it strictly on our behalf to run the Services (such as our payment processor and text-message provider) and where required by law.
3. Information We Collect
Information you provide: your mobile phone number (required) and any name, email, or other details you choose to provide; transaction details (Products purchased, rented, exchanged, or picked up; locations; deposits; rental history); and communications you send us.
Information collected automatically: device and usage data (device type, OS, app version, identifiers, IP address, and how you interact with the Services); location information (the location/locker/vending unit for a transaction, and, where you enable it, approximate device location to find nearby locations); and access and security data (one-time codes, authentication events, logs).
Payment information: payments are handled by our third-party payment processor. We receive limited details (confirmation, amount, last four digits/card type) but do not collect or store your full payment card number.
We do not knowingly collect information from anyone under 18, and you must be 18 or older to use the Services.
4. How We Use Your Information
We use personal information only to: provide the Services (create and authenticate your account, process purchases, rentals, and vending transactions, process payments, and manage deposits, returns, and fees); communicate with you (one-time codes, order and pickup/return notifications, receipts, service and safety messages, and support responses); secure the Services (detect and prevent fraud, misuse, and safety or security incidents); improve the Services (understand usage, maintain and troubleshoot systems, and develop features, locations, and Product offerings); and comply with legal, regulatory, tax, and safety obligations. We use your phone number for authentication and transactional/service notifications; we send marketing messages only where you opt in, and you can opt out at any time. Message and data rates may apply.
5. How We Share Information — And How We Don’t
We do not sell your personal information. We do not “share” it for cross-context behavioral advertising. We do not disclose your personal information to third parties outside Brevvie LLC and its wholly owned affiliates for their own independent use.
We disclose personal information only: within Brevvie and its wholly owned affiliates, to operate, secure, and improve the Services; to service providers/processors that act only on our instructions and only to provide services to us (such as our payment processor, cloud host, and SMS provider), which are contractually prohibited from using your information for their own purposes and which, under applicable law, are not a sale or share; to Location Operators, only the limited information needed to complete or support a specific transaction, and not for their own marketing; for legal and safety reasons, where required by law or necessary to protect rights, property, or safety, or to enforce our Terms; in a business transfer (merger, acquisition, financing, or sale of assets), subject to this or an equivalent policy; and with your direction or consent.
6. How We Protect Your Information
We use reasonable administrative, technical, and physical safeguards to protect personal information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your account, device, and access codes secure and for notifying us promptly of any suspected unauthorized use at admin@brevvie.com.
7. How Long We Keep Information
We retain personal information as long as needed to provide the Services, complete and record transactions, comply with legal, tax, accounting, and safety obligations, resolve disputes, and enforce our agreements. When no longer needed, we delete, de-identify, or aggregate it.
8. Cookies and Similar Technologies
Our website and apps may use cookies and similar technologies to keep you signed in, remember preferences, secure the Services, and understand usage so we can improve the Services. We do not use these for cross-context behavioral advertising. You can control cookies through your browser or device settings; disabling some may affect how the Services function.
9. Your Choices and Privacy Rights
Communications. You can opt out of non-essential marketing messages at any time (for example, reply STOP to a text). We may still send transactional and service messages needed to operate the Services and your account.
California residents (CCPA/CPRA). Subject to legal exceptions, you have the right to know/access, delete, and correct your personal information; to opt out of sale/sharing (we do not sell or share, so there is nothing to opt out of, but you retain the right); to limit use of sensitive personal information (we do not use it for purposes requiring this option); and to non-discrimination for exercising your rights. To exercise these rights, contact admin@brevvie.com or 949-397-6444; we will verify your request (which may require confirming information associated with your account) and respond within the timeframes required by law. You may use an authorized agent, subject to verification.
Other U.S. states. Depending on your state, you may have similar rights to access, correct, delete, or port your information and to opt out of sale/targeted advertising. Because we do not sell information or use it for targeted advertising, many of these apply automatically. Contact us to exercise any applicable right.
10. Third-Party Links and Services
The Services may link to or rely on third-party services (such as our payment processor), whose handling of your information is governed by their own privacy policies. We are not responsible for their practices and encourage you to review them.
